IVA - we have joint accounts. What happens if one of us doesn't want an IVA?

If you and your partner have debts which you took out in both your names then you are both jointly and severally liable in respect of those debts. The creditors are therefore at liberty to pursue your partner for the entire debt. Some creditors may be prepared to wait for their repayment under the IVA. However, some may not so your partner may need to make a provision to continue the monthly repayments in line with the original credit agreement.
